MLB players union sues gambling sites including DraftKings, Bet365 over use of players’ images for bets

The MLB Players Association recently filed lawsuits in New York and Pennsylvania against sports betting and fantasy baseball companies, including DraftKings, FanDuel, Underdog, and bet365. The lawsuits claim that these companies used the names and likenesses of MLB players without proper authorization. Specifically, the lawsuits allege that the companies used player names and images for prop bets without obtaining the necessary licenses.

According to the lawsuits, which were obtained by CBS Sports, the unauthorized use of player images began in early 2024. The MLB Players Inc. asserts that player names, images, and likenesses were prominently featured on the betting platforms and in advertising, enticing customers to place bets based on player performances.

The MLBPA argues that the use of player images for promotional purposes goes beyond providing information to users. The presence of player likenesses on these platforms could imply player endorsement of sports betting, which is not the case. This could mislead consumers into believing that the MLBPA has authorized these companies to use player names and likenesses.

The lawsuit requests a jury trial and seeks monetary damages exceeding $150,000. This legal action follows a previous lawsuit filed by the MLBPA against the Pittsburgh Pirates and Sheetz over unauthorized use of player names and likenesses in advertising campaigns. The Pirates and Sheetz settled out of court.

Representatives for DraftKings, FanDuel, and Underdog did not provide immediate comments on the lawsuits. The outcome of these legal proceedings could have significant implications for the sports betting and fantasy baseball industries.
